YMCA of the USA (Y-USA), the national resource office for 2,700 YMCAs (“Ys”), has selected HIPAA Secure Now! (HSN) as a preferred provider of HIPAA compliance and cyber security services to local Ys nationwide. HSN will help ensure that protected health information (PHI) for thousands of participants in the YMCA’s Diabetes Prevention Program will be safeguarded at Ys offering the program to the public now and in the future.

The scope of services HSN will provide Ys includes:

–HIPAA compliance protocols — conducting mandatory Security Risk Assessments (SRAs) and developing required policies and procedures.

–Cyber security assessments and training — including technical network vulnerability assessments and continuous employee training and testing via security micro trainings, simulated phishing attacks and other tactics for preventing data breaches.

–External data breach assessments – additional training to deepen employee knowledge of thwarting cyberattacks to reduce the high risk of security scams and to prevent PHI from being accessed on the dark web.

–Employee vulnerability assessments — to enable managers to assess whether employees present a high, medium, or low level of risk in terms of preventing cyber security breaches and to reduce those risk levels.

The need for the YMCA to adhere to HIPAA regulations became apparent when the organization developed its program for preventing diabetes, a disease that currently afflicts more than 30 million people in the U.S. As part of that program, participants with prediabetes (approximately 84 million Americans are estimated to have prediabetes) learn to alter their lifestyles by increasing physical activity, eating healthier and losing weight in order to delay or prevent the onset of Type 2 diabetes.

National Institutes of Health research has shown that programs like the YMCA’s Diabetes Prevention Program can reduce the number of new cases of Type 2 diabetes by 58 percent overall and by 71 percent in people over age 60. Such impressive results led to the development of the Medicare Diabetes Prevention Program (MDPP) expanded model, recently finalized by CMS. MDPP has been made available through community and health care settings like the Ys, and the programs are delivered by trained community health workers and health professionals.

Since CMS has designated MDPP services as an “additional preventive services” under the Social Security Act, Ys will have to become Medicare “suppliers” to administer MDPP services and will therefore become a HIPAA Covered Entity. As an MDPP supplier, the YMCA must conform to HIPAA requirements for safeguarding protected health information (PHI) and personally identifiable information (PII).

HIPAA Secure Now! (HSN) and MyMipsScore™ (MMS) are joining forces in a new partnership designed to give healthcare providers a competitive advantage as they adapt to the requirements of MIPS – the Merit-based Incentive Payment System – which determines Medicare reimbursements using value-based care criteria rather than the traditional fee-for-service model.

With the aim of linking reimbursements to the ability of physicians to provide higher quality care at lower costs, MIPS assigns points in various performance categories to establish a base score. The partnership between HSN and MMS enables doctors to maximize those scores and avoid penalties, particularly in the Advancing Care Information (ACI) category of the MIPS assessment.

For medical practices, HSN simplifies the process of conducting a Security Risk Analysis (SRA), a key requirement for earning points in the ACI category (which replaced the older Meaningful Use guidelines) – as well as complying with HIPAA regulations. And the MyMipsScore app eases the task of compiling, calculating, and analyzing data across all 271 quality measures that comprise the MIPS scores.

Pawan Jindal, founder of MyMipsScore, emphasizes the importance of earning points – and potential bonuses – in the ACI category. “If physicians are trying to get the maximum score with the minimum effort and earn bonuses it definitely helps to meet the criteria in the ACI category – especially for the many providers who have already been following the Meaningful Use guidelines,” he said. “But it’s important to remember that medical practices must complete the Security Risk Analysis in order to earn those ACI points and show that they are serious about protecting patients’ health information.”

Not only do MIPS scores serve as incentives for improving the delivery of medical care, they have a direct impact on the bottom line. Based upon their MIPS performance scores in 2017, physicians can expect to see their Medicare reimbursement payments vary by +/- four percent beginning in 2019. By 2022, payments will vary by +/- nine percent.

“MIPS scores affect the reimbursement percentage, and most importantly, patients will know which providers earned high or low scores,” HSN’s Gross said. “When healthcare providers fail to perform a Security Risk Analysis it results in an ACI base score of zero, an automatic loss of 25 points from the MIPS score, lower reimbursements, and a lower ranking – all made visible to the public. When patients see these scores, it affects the reputation of the medical practice.”

Essentially, the Security Risk Analysis process enables medical practices to identify areas where patient health information may be vulnerable to hackers and ransomware demands – and to take steps to protect that data through training employees to avoid phishing scams, establishing encryption procedures, developing breach response plans, and implementing other security measures.

HIPAA Secure Now! is set to handle security risk assessments that will be required of medical practices, under the new MACRA regulation (Medicare Access and CHIP Reauthorization Act), which commences January 1, 2017.

HIPAA Secure Now! helps medical practices comply with HIPAA, and protect their most valuable asset – electronic protected health information (ePHI). The company offers a suite of services, including security risk assessment (SRA), policies and procedures, employee training, live HIPAA consulting, and financial protection.

According to HHS officials, MACRA scoring will depend, in part, on HIPAA compliance and whether medical practices perform a thorough SRA. HIPAA Secure Now! will help medical practices understand MACRA scoring as it relates to HIPAA privacy and security, and perform SRAs to make sure doctors have taken proper steps to protect their ePHI across their entire IT network. For example:

  • HIPAA Secure Now! will guide physicians in locating where all ePHI is stored, whether it’s in the cloud or on servers, desktops, laptops or mobile devices. While the majority of ePHI may be stored in their EHR system, the SRA will also reveal if patient information is stored in Word documents in the form of patient letters, Excel spreadsheets in the form of billing reports, scanned images of Insurance Explanation of Benefits (EOB), and any other sources. An SRA always needs to be performed, regardless of where ePHI is located.
  • HIPAA Secure How! will analyze how patient information is being protected, i.e., back up processes, procedures in place for disaster recovery, and how do deal with lost/ stolen laptops containing ePHI. The SRA will also review procedures for minimal level of access to ePHI by employees, plus termination procedures when employees leave.
  • HIPAA Secure Now! will counsel physicians on having a response plan in case a breach does occur, and help implement that plan in the event of a breach. The plan must specify who will be on the response team, what actions the team will take to address the breach, and the steps they’ll take to prevent another breach from occurring. The SRA will make sure a plan exists and all employees are trained in how to respond.

MACRA, established by the Center for Medicare and Medicaid Services (CMS), ties medical
reimbursements to improved care and better outcomes for patients, while lowering costs. Fees paid to physicians will be scored based on performance and quality metrics, all in an effort to move to value based care.

Initially physicians can see their payments vary by +/- 4% based on their MACRA scores. By 2020 payments will vary by +/- 9%.

In particular, physicians who participate in the MACRA Merit-Based Incentive Payment System (MIPS) will be scored on their extensive use of their EHR systems over time. To earn any score they’ll need to prove that their ePHI is being protected. Failure to safeguard ePHI with the proper IT security controls will result in zero scores, which could have a material impact on the MACRA fee adjustment, and overall Medicare reimbursement.
